1. Introduction
Welcome to Backseat Gaming. By accessing or using our website (the “Site”) and purchasing products from our store, you agree to be bound by these Terms and Conditions (the “Terms”). Please read them carefully before making any purchase.
2. Orders and Acceptance
2.1. All orders placed through the Site are subject to acceptance by Backseat Gaming. We reserve the right to refuse or cancel any order for any reason, including errors in pricing, availability, or product description.
2.2. Once your order is placed, you will receive an email confirmation acknowledging receipt. This confirmation does not signify acceptance of your order. Acceptance occurs when we send a shipping confirmation or dispatch the product.
2.3. By placing an order, you confirm you are at least 18 years old or have parental or guardian permission to make the purchase.
3. Pricing and Payment
3.1. All prices listed on the Site are in Nepalese Rupees (NPR) and are subject to change without prior notice.
3.2. We accept various forms of payment, including Cash on Delivery (COD) and QR Payments. By submitting payment information, you confirm that you are authorized to use the payment method and that we may charge the total amount of your order.
3.3. For Cash on Delivery (COD) orders, you agree to accept and pay for the order upon delivery. We reserve the right to require full advance payment, or to decline future COD orders, from customers who repeatedly refuse or fail to accept confirmed COD deliveries. Orders refused at delivery without a valid reason may affect our acceptance of your future orders under Section 2.1.
4. Shipping and Delivery
4.1. We ship across Nepal. Delivery is free on most items within the Kathmandu Valley. Bulky or oversized items — including but not limited to monitors, monitor arms, and racing simulators/cockpits — are excluded from free delivery, and shipping for these is quoted separately.
4.2. Shipping charges shown at checkout are an estimate based on location and may not reflect the final cost, particularly for deliveries outside the Kathmandu Valley or for bulky items. For these orders, we will contact you after your order is received to confirm the actual shipping cost and your preferred delivery method before dispatch.
4.3. For deliveries outside the Kathmandu Valley, you may choose between branch (counter) delivery and home delivery. Costs vary by destination, courier, and method. Outside-valley orders generally require advance payment of the product and confirmed shipping cost before dispatch.
4.4. As stated in Section 2.2, your order is not accepted until we dispatch it. If you do not agree to the confirmed shipping cost or method, you may cancel the order before dispatch at no charge.
4.5. We are not liable for delays caused by the shipping carrier, natural events, or customs clearance issues.
5. Returns, Refunds, and Exchanges
5.1. In line with the Consumer Protection Act, 2075, you may return an unused product in its original, unopened condition within the timeframe provided by law if you are unsatisfied with your purchase. Proof of purchase (invoice) is required. Refunds within this window are processed without deduction.
5.2. We do not accept returns, refunds, or change-of-mind exchanges for products that have been opened, used, installed, or altered, as we will not resell an opened unit to another customer as new. This is to guarantee that every customer receives a genuinely unused product. This does not affect your rights regarding defective products under Section 5.3.
5.3. If you receive a defective product, you must contact us within 48 hours of delivery with valid photo or video proof of the defect. Once we verify the defect, we will repair, replace with the same product, or — where that product is unavailable — replace it with a similar product of equivalent value. The defective item must be returned in its original condition and packaging.
5.4. Exchanges or upgrades to a different model by customer preference are not covered by this policy. Where we choose to accommodate such a request as a one-time courtesy, it is at our sole discretion and may be subject to conditions.
5.5. Consumables and certain items, including Krytox GPL205G0 lubricants, switch films, and similar products, are strictly non-returnable once opened, except where defective on arrival.
6. Warranty and Liability
6.1. Most products come with a 1-year warranty against manufacturing defects unless otherwise mentioned specifically on the product page.
6.2. The warranty period starts from the invoice date.
6.3. Warranty claims may take anywhere from 7 days to several weeks, depending on the brand’s return or RMA process, availability of replacement parts, or confirmation from the manufacturer. Customers will be kept informed throughout the process.
6.4. This warranty does not cover damage caused by misuse, liquid damage, improper installation, modification, or unauthorized repairs.
6.5. To the maximum extent permitted by law, Backseat Gaming is not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, loss of use, or hardware incompatibilities arising from the use of our products.
6.6. You acknowledge that some products require technical knowledge for installation or modification, and any use or application of such products is at your own risk.
6.7. In-ear monitors (IEMs) carry a 1-year warranty on the IEM unit itself. Cables — whether included or purchased separately — carry a 3-month warranty, as cables are subject to normal wear.
6.8. For warranty claims, the customer is responsible for the cost of shipping the item to us. Where a defect is verified, we cover the cost of return shipping. We are not responsible for items lost or damaged in transit to us; we recommend using a trackable shipping method.
7. Privacy Policy
7.1. We respect your privacy. When you use our Site or place an order, we may collect certain personal information such as your name, address, contact number, and payment details.
7.2. We use this information to fulfill your order, communicate with you, and improve our services.
7.3. We do not sell or rent your personal data, and we share it only as described in this policy — including with parties required to fulfill your order (such as shipping providers or payment gateways) and the analytics and advertising providers described below.
7.4. We implement industry-standard security measures to protect your data, but we cannot guarantee 100% security due to the nature of the internet.
7.5. We use cookies and similar technologies to operate the Site, understand how it is used, and improve your experience. By continuing to use the Site, you consent to our use of cookies. You can manage or disable cookies through your browser settings, though some features may not function correctly as a result.
7.6. We use third-party analytics and advertising services, including Meta (Facebook) and, where applicable, Google, which may collect information about your visit and purchases through tracking technologies such as the Meta Pixel. This data helps us measure and improve our advertising. These providers process data under their own privacy policies. We do not sell your personal data.
8. Intellectual Property
8.1. All content on the Site — including text, graphics, logos, and images — is the property of Backseat Gaming or its content suppliers and protected under intellectual property laws.
8.2. You may not copy, reproduce, republish, or distribute any content from the Site without written permission from Backseat Gaming.
9. Third-Party Links
9.1. Our Site may contain links to external websites or embedded content (such as YouTube videos). These are provided for convenience and reference. We do not endorse or assume responsibility for any third-party content or practices.
10. Governing Law and Dispute Resolution
10.1. These Terms shall be governed by and interpreted in accordance with the laws of Nepal.
10.2. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal.
11. Changes to Terms
11.1. We may update these Terms from time to time without prior notice. The revised Terms will be effective as of the date they are posted. Continued use of the Site signifies your agreement to the latest version.
